Christopher Marlborough New York Overtime Law, Minimum Wage Law, Class Action Law, Wage Theft Lawyer

Christopher Marlborough is a New York Wage Theft lawyer practicing on Long Island, New York City, and New Jersey. He represents workers cheated out of overtime, minimum wage, and other wages by their employers. He has been fighting for Plaintiffs since 2004 and litigating class action lawsuits since 2007.

Prior to attending law school, Christopher saw worker exploitation and wage theft first-hand in the course of his work as a vocational evaluator at a non-profit vocational rehabilitation organization. He provided work readiness assessments and career counseling to persons with disabilities. As a result of this work, he developed a passion for workers’ rights, which continues to this day.

Education

Christopher graduated magna cum laude from both undergraduate and law school. He was also recognized with numerous merit scholarships and awarded the prestigious Sparer Public Interest Fellowship from Brooklyn Law School. He also served on the school’s, Journal of Law and Policy. His student note was selection for publication in the journal.

Professional Experience

Christopher is a former Chair (2018-2019) and Vice Chair (2015-2017) of the Nassau County Bar Association, Labor and Employment Committee. He has provided numerous continuing legal education presentations to attorneys on issues including wage theft and class action law.

In addition, Christopher serves on the Legislative Committee of the New York Chapter of the National Employment Lawyers’ Association (NELA-NY). The Committee promotes NELA-NY’s legislative agenda in protecting and improving the NYS Human Rights Laws and protecting low wage workers. The Committee also monitors employment and civil rights related legislation and issues legal memoranda of support for bills that advance NELA/NY’s goals of a fair workplace.

Since 2024, Christopher has served on the Advisory Council for Documented NY. Documented is a nonprofit news organization dedicated to covering New York City’s immigrants and the policies that affect their lives. Christopher provides input on wage theft issues affecting their readership and promotes the use of Documented’s Wage Theft Monitor, to root out and expose wage thieves in New York State.

Awards

Christopher has been recognized by Super Lawyers magazine since 2013, first as a Rising Star (2013-2014) and then as a Super Lawyer (2014-2025). According to the magazine, it selects only the top 5% of attorneys for its Super Lawyers list and only the top 2.5% of attorneys 40 years old or younger or practicing 10 years or less for its “Rising Stars” list.

Christopher was awarded the 2021 Lawrence Solotoff Memorial Recognition for Distinguished Professional Achievement by the Nassau County Bar Association, Labor and Employment Committee.

He received the 2024 Courageous Counsel Award from the New York Chapter of the National Employment Lawyers’ Association.

In 2025, he was selected by the Long Island Herald for their Top Lawyers of Long Island Award for Employment Law.

Litigation Results

Prior to founding the Marlborough Law Firm in 2013, Christopher worked on a number of high-profile consumer fraud and wage theft lawsuits. In addition, he served on the trial team that secured two jury verdicts for $37 and $50 million on behalf of a class of 150,000 users of Avacor, a phony hair restoration product. His experience representing workers in wage theft lawsuits included a case with 5,000 workers against the Ruby Tuesday restaurant chain.

Since he founded the firm, Christopher has secured more than $20,000,000 in settlement funds for his clients. These settlements include an $11,000,000 settlement on behalf of a class of discount store workers, and a $7,200,000 settlement on behalf of more than a thousand portable toilet company workers. The New York Comptroller’s Employer Violations Dashboard lists these cases as New York City’s first and second largest wage theft settlements in 2020.

In addition, Christopher obtained a ruling in a case against the Buffalo Bills, the NFL, and other defendants finding that the Buffalo Jills cheerleaders were misclassified as independent contractors, rather than employees. The case resulted in a settlement of more than $875,00 for the cheerleaders.

A Woman’s Work: The NFL Cheerleader Problem sheds light on the continued fight to end the gender pay gap prevalent throughout the National Football League. For over 50 years, NFL cheerleaders—women who are lifelong athletes were expected to both maintain a peak physical condition and fulfill extreme beauty standards. Many of these athletes have been historically underpaid, with some earning as little as $5 an hour, while others are never paid a salary at all. A Woman’s Work chronicles the journeys of cheerleaders from the Oakland Raiders and the Buffalo Bills, each of whom put their careers on the line to take legal action and fight for fair pay.

Through the stories of two women in particular—Lacy, a former cheerleader for the Oakland Raiders and mother of three, and Maria, a former Buffalo Bills cheerleader, both of whom take up the grueling fight for fair pay against the NFL—the film paints a vivid picture of gender inequality at the heart of America’s favorite pastime.  A Woman’s Work features interviews with former cheerleaders—some who have filed lawsuits against and others who stand staunchly in support of the NFL—their family members, and labor lawyers.
